State of Alabama
"I, Joseph L. Gauntt, of East Tallassee, Tallapoosa County, Alabama, being of sound mind and memory, do hereby make, publish and declare this instrument to be my last will and testament, hereby revoking all other wills by me at any time heretofore made."
"I direct that all of my just debts, doctor's bills and burial expense be paid as soon after my death as reasonably practicable. I further direct that out of the proceeds of my estate a suitable monument be erected over my grave, same to be done before any division of my estate as hereinafter provided."
"I give, devise and bequeath to my beloved wife, Mattie C. Gauntt, as Trustee, all the property, both real, personal and mixed of which I may died seized and possessed or in which I may have any interest at my death, upon the following trusts and conditions to-wit:
My said trustee, Mattie C. Gauntt, shall have full power and authority to use, consume, manage, and control said estate during her life, and without any order of any court, and in whatever way she may deem best, and my said wife, Mattie C. Gauntt, shall be entitled to receive for her own use, all of the net income from my estate during her life, and if such net income is insufficient for her comfortable support and maintenance, she shall have the right, authority and power to sell, use and consume so much of the corpus of my estate as she may deem necessary for her comfortable support and maintenance during her life, and she shall be the sole and only judge and shall determine the necessity for such sale of the corpus of my estate, without let, hindrance or interference by anyone or by any court."
"My said beloved wife, Mattie C. Gauntt, shall also have the right and power, at private sale and without any order of any court, to join in with the hereinafter named executors, to sell, convey and deliver or otherwise dispose of any property belonging to my estate for re-investment, or for her use in maintenance and support of herself, and in like manner to sell or dispose of for re-investment for her use, maintenance and support any property which she may acquire as trustee or otherwise."
"Upon the death of my said beloved wife, Mattie C. Gauntt, I hereby devise, give and bequeath my entire estate to my children, James Gillis Gauntt, Joseph Marshall Gauntt, Isaachar Grady Gauntt, Curtis R. Gauntt, Ida Lucille Woodall, Lessie Lorena Westbrook, Annie Ruth Range and Marvin F. Gauntt, equally share and share alike; provided however, I have made an advancement to Joseph Marshall Gauntt in the sum of nineteen hundred dollars ($1900.00), in the event this sum has not been paid to me during my lifetime, the amount so due by Joseph Marshall Gauntt shall be considered an advancement to him without interest and shall be charged to his share of the estate and shall be deducted from the respective share to which he would be entitled in my estate; and, also except, it is my will and desire that after the death of my said beloved wife and before there is any division of my estate, and after my death, and immediately upon the death of my said wife, my son, Marvin F. Gauntt, shall receive all of the livestock and farming implements belonging to my estate of which I may die seized of, or which may be left by my said trustee at the time of her death, and such livestock and farming implements are bequeathed to him in addition to his distributive share of my estate."
"In the event I shall outlive my said beloved wife, Mattie C. Gauntt, and she shall die prior to my death, then in that event I hereby give, devise and bequeath unto my beloved children all of my property, both real and personal, of which I may die seized and possessed or in which I may have any interest at my death, upon the same terms, conditions and manner as hereinbefore provided in Item 4; and, in the event of the death of my beloved wife prior to my death, I hereby direct that all of her just debts, doctor's bills and legal charges against her estate be paid out of my estate; and also that in event a suitable monument has not been erected over her grave prior to my death that same be bought and erected with proceeds belonging to my estate."
"It is my express intention that in the event any of my children are dad and leaving issue, that these children shall receive in equal proportions the share which my own child would have received if living."
"My bequests and directions shall be limited expressly and superceded by this direction to my executors, that in the event any of my children should contest this will, in lieu of all other bequests, I devise and bequeath unto the said child or children contesting this will the sum of One Dollar each, which shall be paid in cash by my executors and shall be a full aquittance of all amounts due said child or children under the terms of this instrument."
"It is my will that my beloved wife, Mattie C. Gauntt, and my sons, Isaachar Grady Gauntt and Marvin F. Gauntt, be appointed executors of this my last will and testament, and I hereby relieve them and each of them from making any and all bonds to any court for their acts in the premises. I further relieve and exempt my said executors from making any inventory of my estate, or any report of any kind whatsoever to any court. I further direct that in the event of the death or incapacity of either of my said executors, I hereby authorize and empower the survivor to execute and carry out the provisions of this will, and exempt such survivor and relieve him or here of the necessity of making any bond, and of making any report of any kind to any court."
"It is my will that my estate be administered with as little expense and trouble as possible, and therefore I do hereby give to my said executrix and executors full power and control of my entire estate, both real, personal, mixed or otherwise, to manage according to their best judgment, that is to say, they have full power and authority to contract, lease, sell or otherwise dispose of any of my real or personal estate, to be used for the benefit of my beloved wife, and that such sales, leases, contracts or conveyances shall be legally taken and accepted in all things as though I were living and doing the same in my own proper person; but in all such transactions I admonish, care and prudence. In witness whereof, I hereunto set my hand seal on this the 5 day of May, 1937."
